As someone who’s just started as a sole trader my answer is yes.

However, and this is a huge point to consider, the IRD and anti money laundering laws would look highly unfavourably at a “business” that has expenses and zero revenue. Their website states these exact words.

Surely if you’re spending money advertising you’ll make some for of income, it may not be profitable right away but yeah.

Yes, fine. No requirement for profit, only to have a nexus with revenue. Lots of business have no revenue in early start up phases.

If audited youÔÇÖd need to be able to demonstrate a plan for how you aim to achieve profitability and that you are claiming deductions against a genuine taxable activity (that will with the expenditure claimed, result in revenue).

Note you claim deductions against zero business revenue not your employment income, however that the end result is the same conflates the difference between the employment limitation on deductions and self employment. The tax credit resulting from a taxable loss will offset any underpaid employment PAYE liability or result in a refund.

There is no nexus with employment revenue, and deductions are barred anyway. ItÔÇÖs not ring fenced like rental income, but it is in the way the tax act treats these separately but then lumps them together at the end.

Think of it like baking; mix all the dry ingredients together, mix all the wet ingredients together, then combine to make the cake.

I started a business (so LLC rather than sole trader). I had significant expenses before any income ($100k or so). I had to provide IRD with a whole bunch of proof that this was genuine.

I wasn’t allowed to offset this loss against income. I had to get tax credits which I was able to use in future years once it started making a profit. I believe that’s because it is a LLC and would be different as a sole trader.

You need income to deduct the expenses against. It’s fine (and normal for a new business/venture) if the expenses come before the income does, but you need some income as a result of the expenses that you’re hoping to claim. Hopefully you’ll have some by the end of the financial year.

  • westie-nz

You can’t deduct business expenses from paye income, sorry.
