The Importance and Impact of AI Legalese Decoder

Introduction: The Current Situation

Currently, I reside in Louisiana and have been facing challenges in co-parenting with my child’s father. Over the first 5-6 years of our child’s life, he had been inconsistent and sporadic in his involvement. This was primarily due to his severe alcohol abuse, which led me to make the difficult decision to leave him shortly after our daughter’s birth. Despite his promises of sobriety when he had custody, I later discovered that he had been deceitful and continued to drink during those times. Frustrated by his behavior and tired of living a life filled with lies, I decided to withhold our daughter from him for approximately two years. However, during that time, he resorted to insults, threats against me, and even made false threats against non-existent boyfriends. Eventually, he seemingly gave up and ceased contacting me.

The Unexpected Turn and My Growing Concerns

Unfortunately, one of my family members disregarded my wishes and allowed him to spend time with our daughter. This turned out to be a pivotal moment, as our daughter developed a desire to spend time with her father. Believing he had made positive changes, I allowed their interaction. Initially, things seemed to be going wellÔÇöhe began providing some financial support, attending school events, and generally showing an increased level of engagement.

However, recent events have revealed a troubling truth: he has resumed drinking. It was our daughter who alerted me to this fact when she recognized an alcoholic beverage my fianc├® had purchased and stated, “daddy drinks like 5 of those a day!” Naturally concerned, I probed further and she confirmed that he not only drinks, but also drives under the influence with her in the car. She disclosed that his drinking resurfaced about a year ago, and since then, he has become more verbally abusive towards her, displaying instances of unwarranted anger. Shockingly, she even shared that he threatened to harm her beloved pet cat.

The Dilemma: Seeking a Solution

Considering these distressing circumstances, I find myself contemplating a move out of state with my daughter. However, I am uncertain about the legal implications of such a decision since we lack any formal custody arrangement through the courts. Prior to discovering her father’s relapse, I had already considered relocating, but now this urgency intensifies that desire to create distance between us. It is important to note that I have refrained from filing for custody, as a family member who had a significant influence in my life advised against it, claiming it would ultimately lead to her father obtaining primary custodyÔÇöironically, this same family member facilitated their reunions. Nevertheless, I have severed ties with this individual due to other pertinent reasons.

The uniform child custody jurisdiction act requires a child to be living in a state for 6 months before that state will have jurisdiction over the child. Otherwise jurisdiction will be in the last state where the child did live for 6 months and if no such state exists the state where the child was born. If a child is taken from the state where jurisdiction is proper and a case is filed in that state by the remaining parent prior to the 6 month mark an order will be issued requiring the child to be brought back to the prior state and that state will manage the custody proceedings until such time as both parents have permanently moved out of the state. Unless there is a court order in place itÔÇÖs generally not illegal to take a child out of the state without consent of the other legal parent, however the court may frown upon it and if an order to return the child is ignored it would become a criminal issue.

So you can move, but if he files in LA in the next 6 months you are going to have to litigate in LA. As to how that would play out, no one can say, but given his drinking when he is watching her and his general lack of involvement I doubt he would get a ton of custody, but IÔÇÖd also be shocked if he didnÔÇÖt get some.

The child will still be a Louisiana child for six months so if he files a paternity case that state could very well make you bring her back. So much drama and disruption in her life already. IÔÇÖd advise you to do it the right way, file a paternity case and get legal custody. Bring witnesses and evidence to show heÔÇÖs unfit. YouÔÇÖll get child support too. Oh and go take that poor cat! Maybe the last part isnÔÇÖt sound legal advice but IÔÇÖd totally do it. ItÔÇÖs your daughterÔÇÖs pet.

  • C1awed

It’s not illegal for you to move.

He can file to have the child moved back to Louisiana. No, that won’t automatically give him primary custody, but it would mean that, effectively, he could make you move back with her.

I very highly recommend finding a lawyer and establishing proper custody and child support. There are a lot of women in your situation, and so there are often lawyers who are willing to work on a reduced fee schedule or otherwise work within your financial situation.

  • Connect_Office8072

You, more than anyone IÔÇÖve seen on this site, need a local attorney. Louisiana has some strange laws. ItÔÇÖs laws are not based on common law, but rather on a civil code reflecting the French rule that existed there.

    NAL –

If you have no current court ordered visitation and legal custody established technically both of you could leave the state with the child.

If you have a current court ordered visitation and legal custody established, you need to follow it.

    Now some words of wisdom.

If you leave and he files in your current state, youÔÇÖll likely be forced to bring her back and the courts will likely frown upon your attempts to take her against his will. When establishing best interests of the child, one thing looked at is ÔÇ£willingness to support a loving relationship with the other parentÔÇØ therefore your action could be viewed as you being incapable of doing that, especially with your previous actions where you kept her away. Regardless of what he was doing, courts donÔÇÖt find favor in you making that decision of your own.

Also, if you file in the new state, he can simply file a change of venue and argue that the new state does not have jurisdiction- this will be accurate if you hadnÔÇÖt had enough time to establish residency in the new state.

I want to also add that in regards to his drinking, your likely not going to end up being able to use that to gain sole custody or to squash his ability to have some visitation. Most likely his lawyer if he attains one will immediately send him to rehab and would likely use his rehab as proof the drinking isnÔÇÖt as big of a deal as your making it. Also, theyÔÇÖre unlikely going to take the word of a child as to whether or not he is driving under the influence with her so unless he gets caught doing that, itÔÇÖs not likely to even be admissible or considered.

Your best move is to file where you are for visitation and custody. Try to get him to agree. But youÔÇÖll be playing with fire trying to test a judge. This country is more and more into 50/50 and they donÔÇÖt care if you like it or not

  • LammyBoy123

If he’s been drinking and driving, report him as a drunk driver if he’s operating a motor vehicle. If he’s drunk, he will get arrested. If he keeps doing it, hopefully he gets a felony.

Keep look into lawyers. It may takes sometime. Family lawyers are busy. Id recommend call cps about your concerns with your ex. If still have those threatening messages from your ex great keep them. Hire a reputable private investigator. To follow your ex while he’s has your child. They can document drinking and driving or other things done publicly and call cops if needed. Even if ex drank at home but then got into the car with your child and was driving erratically they can call the cops.
You can also look to see if ex has any dwi/dui court records online.

Your local district attorney may be able to help. See here:

Edit: If you are and have been the custodial parent, you should be able to get child support out of him.

  • aca-awesome-

    Have you filed for divorce?

  • Low-Focus-3879

    > We don’t have any sort of custody arrangement through the courts.

That’s what is important here. You don’t have an existing agreement, so either parent can move her outside of the state without violating a court order.

Based on the circumstance you described, do it now to protect your kid,

  • JudgmentFriendly5714

Some critical info is missing. Is your ex legally her father? Were you married when she was born or he signed an acknowledgement of paternity?
if he isnÔÇÖt legally her father you could Leave and heÔÇÖd have to establish paternity and fi,e for custody to force your child back

  • floofybabykitty

Try to get the cat too tbh

  • Top-Sweet-3444

Why not confront him via text. Let him know your daughter doesnt want to be around him because and you are not comfortable because she mentioned you were drinking alcohol around her and while driving.
