legal Issue with PayPal Australia Contracts
Australia’s federal court recently ruled that PayPal (NASDAQ: PYPL) Australia had included an unfair term in its standard contracts, resulting in incorrect fee charges for small businesses. According to the Australian Securities and Investments Commission (ASIC), this unjust clause allowed PayPal to keep fees that were charged in error if customers did not report them within 60 days of receiving their account statement.
This ruling affects small businesses that opened a PayPal business account between September 21, 2021, and November 7, 2023. In response to the investigation, PayPal cooperated, acknowledged the unfairness of the term, accepted the court’s declarations, and removed the problematic clause from its contracts on November 8, 2023.
The federal court deemed the unfair term void from the beginning of the contracts and also required PayPal to cover ASIC’s litigation expenses.
