## Seeking Early Release from Probation in Pennsylvania

This may be long winded and completely understand if anyone wants to skip over.

I am in PA and was sentenced to 2-5 with 5 years probation running consecutive on an aggravated sexual assault. I was released in my minimum and now 1 yr into my 5 yr probation. I have had no issues in my past 6 years or ever with law enforcement for that matter.

I contacted my attorney to file a motion for early release from the probation sentence. He asked me to outline reasons I am requesting early release. Ur jobs out of state ect.

Can anyone provide guidance or suggestions for asking for early release? Or what they may have experienced? My biggest issues are with housing and jobs. The fact that my PO needs to contact either or both puts me in a spot when owners and companies don’t ask about criminal history. I’m not trying to hide either, but it would be nice not to have to disclose if not asked.

Are there any other reasons I may give for early release?

    It might be a difference between state probation vs county, but I was in county probation in PA and was told by my PO that people are required to serve at least 1/3 of their probation. My PO supported me getting done early and I wrote a letter to the judge outlaying that I had completed therapy, rehabilitation, kept a steady job for years, have committed no other offenses or infractions of any kind, and had never violated probation or caused issues in anyway, etc. Ultimately it’s the judge’s opinion, it doesn’t need to have a basis in anything. I was denied. That said, it costs nothing to try and doesn’t affect you negatively.

    You could also make a case that you’ve already paid off probation completely and restitution and cause no issues, so they’re spending money supervising you when they could be using the resources elsewhere.

    That is a pretty light sentence- considering. Would the four additional years of probation really be that big a deal. When you say that you were sentenced to 2-5 years of prison, was that not nailed down to a specific number of years/months? I have not heard of a prison sentence being so vague.

    I find it very weird that your lawyer didn’t give you some suggestions on what would have a better chance of being successful. Not saying he should just tell you to make it up, but it’s so broad you’d think he’d have SOME ideas to help.

    In PA I was told the judge gets the input from the victim before ruling on an early release request. An honest attorney will tell you the realistic expected outcome as they often go with the victims wishes. You will face the same issue, with or without the PO. If you are an SVP, you will be required to tell your employer regardless of probationary status, or off supervision. It’s not insurmountable, and best of luck.
