### Situation Overview
My husband has 2 kids in Illinois but we currently live in Arizona. Their mother filed for child support back in 2020 when we still lived in Illinois. They have been going to court back and forth for 3 years now modifying the order every time (only increasing). He had a set amount ($900ish) plus a 7.5% on commission and OT a month which my husband has to send her via money order. He also has to email his paystubs to her! She kept claiming she wasn’t receiving those money orders and that the amounts were incorrect. Due to this, another court date was set for today. In that same order, it was set that my husband could call/FaceTime the kids whenever but specifically Saturday’s at 10am. However, the mother has blocked my husband’s phone number on the kids’ phone. He hasn’t been able to talk to them in approx. 10 months.
### Current Developments
Today, they are claiming the mother only works part time 16 hours a week making $23k a year. This raised my husband’s set amount to $1557 a month. We also suspect the kids are not living with her as she claimed she moved, however, after speaking to some family in Illinois, we suspect the kids are living with her BF’s sister.

You need to hire a Private investigator. Hearsay and rumors don’t do you any good. Hire someone to follow her around and document everything. Then have your lawyer hit her with a move away order. If your lawyer isn’t getting you results then hire a different one. Lawyers will sit back and nickle and dime you forever, especially in a case like this. There is zero incentive for them to seek an end to this
Child support and custody are separate issues. He needs to file for enforcement or more custody depending on what he wants. After that, he can file to adjust child support.
He will always be at a disadvantage appearing telephonically or virtually. He needs to hire a local attorney to appear on his behalf to contest child support and enforce visitation
Ok- so here is what will help.
#1 go back to court for custody. Keep track of every blocked virtual visitation, that is contempt of a court order if that is in the custody agreement. Also, if it is financially possible for your family- try to apply to take the kids on their breaks.
#2 an argument should be made as to why she can’t work full time . Is she or one of the children disabled? Taking care of a sick relative? The children are getting older and more capable of being left on their own or in the care of a family member/sitter (which he would be charged with paying for half of the expense).
#3 any paystubs should be sent to the child support department, not the other parent. Work with the caseworker. They are a neutral 3rd party, they aren’t really invested in either side. He would have to fill out an authorization form to give them permission to speak with you, but if you call they can give general information.
The child support is calculated on gross income and visitation. I put a link for Arizonas explanations for you. It explains really well.

That’s between your husband and her. I’d stay completely OUT of it.
I hate Illinois and I hate child support there!! If it was the other way around they wouldn’t make the mother pay a dime. Illinois iso crooked and I’m so thankful I moved out of that crap state
