## Rental Agreement for Apartment Car Space
I am currently renting an apartment car space from an acquaintance to store one of my cars, which is strictly used for track purposes. The car, although registered and having Compulsory Third Party (CTP) insurance, does not have any other insurance coverage as it is only used on the track, and standard insurance policies do not cover damages that occur during track use.
## Overseas Situation and Car Mishap
As I am currently overseas, I entrusted the car key to the acquaintance who assured me that he would help start the car weekly and let it idle to prevent a flat battery. However, I received a disturbing call early in the morning informing me that the acquaintance had taken the car out for a joyride and ended up crashing it, potentially totaling it.
## Potential Sale and Legal Rights
To make matters worse, I was in the process of selling the car to another individual for $70,000 upon my return to Australia next week. Given the circumstances, I am now questioning what legal rights I have to hold the acquaintance accountable for the damage to the car.

Does this person have any money to pay said damages? You would probably have to look at suing them which won’t be cheap and even if you are successful, if they have no money you can’t get blood from a stone.
Unfortunate lesson in why you should not trust people you don’t know with expensive uninsured things. Sorry that this happened to you.
Essentially bugger all.
The amount is too large for small claims.
It’ll cost a large amount in magistrates, and it depends if he has the money / assets.
**edit**
Driver being under 18
You have zero recourse. The parents have no liability, you can’t enforce collections or bankruptcy to a minor.
Unfortunate but yes, you’ve learnt a valuable lesson about trusting people. It sucks but it’s something nearly everyone goes through.
For next time, get insurance. Even if it’s just ‘laid up’ cover for when the car is sitting would have covered this. It can be very cheap too. Very bad idea to have anything worth that much without insurance.
Did you or anyone else file a police report?
Omg I’m sorry to hear that as a car enthusiast
It is theft to take a car without permission. It’s now been damaged. You can go to the police and ask them to charge the kid, then you can get money from the victims of crime fund, or they will make the kid pay restitution. No one can right off a car and walk away with no consequences.

Is this not theft? I get that you left the kid the keys, but without permission to drive it surely it was stolen?
I’d tell the kid to have his parents settle up now or you’ll report it as the theft it was
