## Situation Overview
My adult disabled twins are currently in the process of applying for SSDi Adult Disabled Child benefits through their mother’s disability. Our lawyer has advised that this is the best approach to start the application process for benefits. Both of my twins have been disabled since birth and have attended college, but they are unable to work full-time or live independently without supervision. They are both 25 years old and have no income.

## Tax Concerns
I am unsure whether declaring my twins as dependents on my 2023 taxes will pose any issues. My tax accountant has informed me that “until they start receiving benefits, they are considered your dependents.” However, I have been unable to find any confirmation of this claim online.

## How AI Legalese Decoder Can Help
The AI Legalese Decoder can help in this situation by providing clarity on the legal terminology and implications related to declaring disabled adult children as dependents for tax purposes. It can analyze the specific circumstances and legal requirements involved, offering guidance on how to proceed without jeopardizing their SSDi Adult Disabled Child benefits application. Using the AI Legalese Decoder will provide accurate and personalized assistance, ensuring that the tax declaration aligns with the legal regulations and does not impact the ongoing benefits application process.

This is a tax question, not a question about SSA programs.

I’m a 36 year old DAC recipient who lives with his parents. They claim me on their Tax returns every year.

Did you file for them for SSI at age 18? If not, why? Assuming your post is accurate (and biological mother is now deemed disabled), they MAY be determined as DAC’s. Depends on what medical documentation you have. Also, did they get a high school diploma? A college diploma or certificate?

They were your dependents in 2023 because you supported them. Future possible benefits don’t change that.
Once they start receiving benefits, you will need to calculate their total support and compare your contribution to the amount of benefits they will receive. That will determine if you can claim them as dependents in the future.

The mother should claim them unless they live with you for over half the year
