## Current Situation with Child Support

Hello everyone,

I am not looking for legal advice, but rather personal experiences and stories regarding my current situation with child support. When child support was initially set up, I was self-employed for only three months before transitioning to a W2 contract to hire position. I made efforts to have the child support deducted from my paycheck through my employer, providing them with the necessary paperwork such as orders and case numbers. However, this did not happen, so I resorted to making direct payments through Zelle.

Fast forward to now, I am still facing challenges with having child support deducted from my paycheck. Despite my repeated requests, I was informed by my employer that they need to wait for the state to send them the information before they can begin deductions. In the meantime, I continued to make direct payments for the correct amount. Recently, I received an email stating that child support will finally be deducted from my payroll, but with back child support included. Upon logging in, I discovered that the arrears amount to $18,000.

I promptly contacted the relevant authorities, filled out an affidavit, and provided proof of each payment made. The recipient was sent the necessary form to approve the arrears, and although she claims to have filled it out and sent it back, it has been over three weeks with no resolution. I am hesitant to escalate the situation to court, but I am willing to do so if necessary.

It is possible to get credit. It’s not guaranteed because you knew there was a court order directing you to pay through the state. If the mom fights it and the judge is harsh, he/she could decide that all of your payments are considered gifts.

If you find out that mom doesn’t agree to give you credit, you should hire an attorney.

This happened to my husband last month. His ex initiated a custody case back in 2022, which she lost. He has been overpaying paying her the entire time the custody battle was going on through direct deposit. The case took 2 years because she got caught with paystubs falsification to hide over a 20k increase in salary in the child support calculation process. An order for child support was made, but my husband realized that they had a CS arrearage on his account. He reached out to the ex, and she claimed she didn’t know anything about it and was resistant to sending an affidavit to the CS office. After his lawyer reached out about a motion to get this sorted out, she quickly sent the affidavit the next day. You can file a motion to have this resolved(they will credit your account). If you have an order for CS that corresponds to the same amount you have been paying directly to her, no judge is going to claim it’s a gift. You have to act fast though because you have a delay to contest the arrearage.
Hopefully, your ex is not dishonest and possesses good moral integrity. The type of coparenting relationship you have is irrelevant to the fact that you have been paying her, and she should report it as such.

    Good luck,

I filled that out too ( paperwork saying he paid). Which now he doesn’t but anyways. They sent my ex paperwork as well. You can call child support in your area and ask how to prove you have paid all this time. Zelle direct deposit would be easy to prove.
