The next day, the manager texted me insisting on a meeting regarding the cancellation. After work, I called the club, only to be informed that the manager does not work after hours. I questioned the need for a meeting to cancel my membership since I am no longer under a lock-in contract. However, the employee could not provide a clear answer and asked me to call back the following Tuesday.

Reviewing my contract, I found no mention of requiring an in-person cancellation. According to Clause 10, I can give a 30-days written notice via email. Despite this, the club is ignoring my emails and I am unable to visit in person due to the distance and my work schedule.

    Once your notice period is up follow up with another email letting them know, then contact your bank and cancel your direct debit.

    I have dealt with this exact issue before.

    If the 30 days are up on your contractually obligated notice period, send a follow-up email advising that you notified them in writing via email on the date you sent the email, the 30 day notice period required by the specific contract clause have now expired and you are taking steps with your financial institution to force stop payments.
    If they have taken payment after the 30 day notice period expired, issue a transaction dispute with your financial institution and provide them with a copy of the contract and your email cancelling your membership as the evidence for the transaction dispute.
    They should be able to charge the transaction/s back and recover your funds. May take up to 6 weeks.
    If they won’t help, send a letter of demand using a free online template and contextualise it to include the section of the contract, the details of date and time stamp of your email, the date at which the notice period expired, details of transactions taken after the date of expiry and a demand for the refund of these funds in full to your nominated bank account within 30 calendar days.

    If they fail to comply, lodge with small claims and get your money back.
    The letter of demand, contract and emails will all sufficiently prove you had fulfilled your contractual obligations for notice of removal of direct debit authorisation by cancellation of the contract and the magistrate will issue a court order for reimbursement. This should also include a costs order to recover the costs of lodging the claim in court (not that expensive and is worth it for both the principle and to create a legal paper trail to help others having issues with the same thing from the same gym.

    This is far too common of an occurrence and if the small claims court starts to see a pattern of similar behaviour by the gym, they are more likely to help others in your position when bringing claims.

    Email them again, noting their response to your initial email as an acknowledgement of your request to cancel, and state that you now consider the matter closed and will take legal action if they continue to withdraw funds from your account. Perhaps make direct reference to the contract clause about cancellation in writing.

    The “must meet the manager” thing is a predatory way of making cancellation more difficult, but your follow up email should be enough to convince the manager that processing the cancellation is the simplest and cheapest option for them.

    Sounds predatory. I’d talk to the ACCC and complain about their cancellation practices and cite things like financial hardship and unbreakable agreements.

    I can’t believe something as unimportant as a gym can use these intimidating tactics, especially after they have told you you can cancel.
    I’m with Kogan internet, and have cancelled and rejoined numerous times now, *as per their advertised terms*, without drama, all by email. Imagine if *they* (or a streaming service) went on with this nonsense?

    I feel like you could write something like “Don’t be ridiculous, there is no need for me to attend in person for you to acknowledge a genuine and original authority to cancel this membership, whether it via a phone call, email or registered letter. For your comfort I will email and call every second day for the next week. If you will not acknowledge these communications, I will authorize my bank to stop DDs immediately. Any further correspondence from you will be tabled with previous communication attempts and submitted to (whomever is applicable) VCAT, ACCC, ombudsman, etc. As it stands of today, I am ready to report you for creating this cancellation difficulty, when I have emailed my cancellation notice, on X date, as required.”
