File an Anti-SLAPP lawsuit. Seek sanctions against both landlord and their attorney
Did the apartment state your rejection was due to the pending lawsuit?
Well first step is getting an attorney and settling in for a multi-year legal battle.
Second step is listening to said attorney, sharing all of the information they ask for, regardless of if you think that info is good or bad for your case. Attorneys should be given all information, detrimental or not, to your case because it will help them assess strategy and options.
Depending on the facts and the jurisdictions involved, you may not have a strong case, or you might. It really all depends on information you probably shouldnÔÇÖt share on Reddit.
Edit: hit post a little too soon.
I was denied an apartment because my former landlord had filed a SLAPP lawsuit against me with false claims.
I was recently looking for a new apartment and found the perfect one for approximately 11 hundred dollars per month. But because of a pending lawsuit I was denied the apt and I had to get a different apartment that was $500 more expensive per month. The company that sued me was + & R prop3rties. In + & r’s own rental statement(pictured above), they state they can deny people due to pending lawsuits, so they knew this was potentially going to happen to me once they sued me. What would be my cause of action for their lawsuit causing me to get denied from the cheaper apartment and having to get a more expensive one?
(I know it sounds counter intuitive but the more expensive apartment complex didn’t deny me due to the lawsuit, I was just heavily scrutinized and had to put down a $1,500 security deposit)
Sounds like you should sue both parties. You have real damages.
Wait, pending lawsuits appear on your credit? Since when!
