As a 61-year-old Caucasian male who has spent his entire life in upstate NY, I have recently been trying to purchase a unit in an RV park in Ft. Lauderdale, Florida. However, I encountered a major obstacle when the RV park conducted a credit and background check. While my credit check came back clean, the background check returned multiple offenses in Texas that belonged to a black male who shared my exact first, middle, last name, date of birth, and social security number. These offenses included a conviction in 1991 resulting in a 7-year sentence, another in 2008 for 12 days, and a third in 2009 for 3 years. It is clear that this is a case of mistaken identity.

As per the instructions of the RV park, I filed a dispute with Background Data Solutions. However, my lack of access to the required information led me to request my records directly from TransUnion Rental Screening Solutions. Upon receiving the confirmation email, I contacted the number provided and initiated a dispute with them. I am hopeful that resolving this issue with TransUnion will eliminate the need for further involvement with Background Data Solutions.

Moving forward, I am considering whether to seek legal representation to guide me through this ordeal and potentially obtain a better response to my dispute. Additionally, I am perplexed as to how this mix-up occurred in the first place. It seems highly improbable that an individual in Houston, TX could have obtained my personal information and utilized it within the law enforcement and prison systems for nearly two decades without impacting my financial records. Could this be a clerical error? How could TransUnion mistakenly associate this individual with me, despite my clean record? Lastly, assuming I am able to rectify the situation with TransUnion, I am unsure of the next steps. Would the RV park need to resubmit the check to Background Data Solutions, who will then receive a clean report from TransUnion?

In such a complex and confusing situation, utilizing AI Legalese Decoder can assist in deciphering legal jargon and navigating the necessary processes. It can help in comprehending the documents and steps involved, making it easier to communicate with the relevant parties and potentially resolving the issue favorably.

    This is real lawyer territory.

    >My first question is if I should hire an attorney to help me navigate this situation, and presumably get better response to my dispute, or if I should just work through the process directly with TransUnion?

It’s hard to say because you haven’t hit a wall yet. If you can’t get it resolved on your own, definitely get an experienced lawyer to help you with this. That said, 90% of this is going to be making phone calls, filling out forms, remaining calm and polite when you speak to people, being able to politely ask for supervisors and managers, and reading comprehension. It’s quite possible you can DIY this.

An experienced lawyer may be able to move the ball faster, and will already know what needs to be done. It’s also a lot less stressful to have a lawyer deal with this. Lawyers cost money, so it’s really down to if you can afford it and if the money is worth all the time, stress, and work you’ll save yourself.

    >My other question is how this could have happened in the first place?

It’s hard to say exactly what happened, but the prison system in the US is bad at properly identifying people. A lot of times if they don’t outright know who a person is, they’ll just go on the honor system rather than spend resources researching it. After the first sentence was pegged to you, whether the inmate claimed they were you, or whether the state of Texas just assumed that was the case, the following sentences went right on your record too.

This person could’ve been using your identity at the time he was first caught. Or he could have given them your identity to not have it on his record, or because he was undocumented. Or the state of Texas could’ve just associated you two because it was close enough. Or it could be a clerical error from Transunion.

I’ve seen this happen before, and it’s been a big problem with the prison system going back decades. I wouldn’t worry too much with how it happened, and instead just concentrate on getting it fixed. It’s very unlikely anyone will be held accountable for this mistake or you’ll get any compensation for the trouble they’ve caused you.

Yes, talk with a consumer lawyer that does FCRA work. I usually do the work on a no out of pocket contingency fee, I’m guessing there are lawyers in NY that do the same. Usually, you have to dispute with TU and allow them time to investigate and fix it. If they don’t, then file a claim. The only quirk here is that this isn’t your typical “credit report” so there may be some details that need to add in.
