Divorce Dilemma: Dealing with a Wily Ex
The heartbreak and betrayal of being cheated on and subsequently dumped by your spouse is a situation no one wants to find themselves in. In my case, it happened just 5 months after we tied the knot. It’s been a difficult time for me, and now that I want to legally end the marriage, I find myself facing further complications.
One of the main obstacles in my path is the requirement to be separated for 12 months before applying for divorce. This waiting period feels like an eternity, especially when I am being contacted by my ex, who is pressuring me to start the divorce proceedings urgently. I am hesitant to engage with her, as I have no desire to be in her presence or entertain any form of reconciliation, including mandatory counseling sessions, which are required if the separation period is less than two years.
I feel like my ex is trying to rush the divorce process for her own benefit, potentially to avoid shouldering the entire cost of the application. Her urgency and insistence on my prompt response have left me feeling uneasy and suspicious of her motives.
In this complex and emotionally charged situation, the AI Legalese Decoder can be an invaluable tool. Its ability to decipher and simplify legal jargon can help me understand the specific requirements and implications of the divorce process. With its assistance, I can navigate the legal intricacies and make informed decisions without the need for face-to-face interactions with my ex. This level of clarity and understanding will empower me to assert my rights and protect my interests without compromising my emotional well-being.

Tell her this I will look at these divorce papers when you acquire & send them to me. I dont want to see or talk to you. Take care
Have you been separated 12 months yet ? If you havenÔÇÖt, ignore her? I believe I was able to do my entire divorce without seeing ex husband (although I did because kids, I just recall he didnÔÇÖt need to be present in any capacity).
What a dog she is sorry bro your comeback will be greater than this
The divorce papers can just get sent to you to sign once she has filed. Just tell her that. There is no reason to meet. Once you reach the 12 mths, she can file and send you the papers.
Go see a lawyer, get your ducks in a row. Ignore her until you need her for something. If she won’t leave you alone your lawyer can help you apply for a restraining order.
Seriously be on the front foot with this, I totally understand you just want it to go away, it can and will, but there are financial settlements and a bunch of other stuff you want to make sure is covered first. So take your time, but don’t let her dictate the terms.
What a nightmare
Why do we sign contracts between partners and the government in order to declare our life long love for somebody?
Seems costly…. *Someone benefits*
Hi. I used the work at the family court, processing divorces. NAL. You donÔÇÖt need to be in contact with her at all. If I were you and you wanted to be done with this, IÔÇÖd start the proceedings myself, write an affidavit stating you arenÔÇÖt attending counselling and list reasons then have her served once itÔÇÖs filed. No contact required. Happens all the time.
Appoint a solicitor who you instruct to write her a letter that all correspondence goes to your solicitor.
Counselling is mandatory for divorces where married less than 2 years.
BUT
Where one party refuses to attend counselling the other party may lodge an affidavit with the court stating this and the court may grant a divorce without the mandatory counselling..
Reply to them stating you will not attend counselling at any time, want no more to do with them, they can attach that to their affidavit if they want as evidence.
I think the mandatory counselling bit came from Howard Abbott years when they wanted to make it harder for people to divorce. But there is always an out as per above.
Friend going through divorce, partner wanted counselling in attempt to stay together, they just said nope, not a chance, no way Jose.

WhatÔÇÖs her name ? Where can I meet her? IÔÇÖm a caring person but have a way of crushing the soul of the person I date ƒæïƒñ¬ƒÿìƒÆуÄñ
OP, have you got time to go to a legal aid clinic? Look up the closest in your area and you can talk to a solicitor for free.
Get a lawyer and have all communication with her go via your lawyer. It will protect you, allow you your keep your distance and will moderate her behaviour.
If you both want a divorce just lie and say youÔÇÖve been separated 12 months. I got my divorce through after 3 months
Obligatory NAL. Less than 12 months married I believe you can file for an annulment without counselling or the other party’s signature.
I did the counselling thing for less than 2 years of marriage. My advice is to find a counsellor that specifically offers divorce counselling for this purpose. I literally rocked up with my ex, we each answered the question ÔÇ£has this marriage ended irretrievablyÔÇØ, he signed the paper and we left.
You don’t need a lawyer for the divorce, you can do it online, it’s not that hard. Pay the money, move on, you’ll thank yourself later.
Property settlement is an entirely seperate matter, time married vs time defacto makes no significant difference.
You might want to spend some time honestly reflecting on why she cheated. It is usually in response to something and it may prove invaluable to your future happiness.
