Can I Request Support Be Put on Hold Through CSEA? Should I Contact a Lawyer?

As a concerned parent, I am facing the dilemma of wanting to provide the best for my daughter while navigating the financial implications of her decision to move in with me full-time. My daughter, who is 14 years old, has expressed her desire to live with me and enroll in my city’s school for her sophomore year, which has brought great joy to me and my wife. However, with this decision comes the question of whether I should continue to pay child support to my ex-wife.

The idea of continuing to pay child support to my ex-wife when my daughter will be living with me full-time seems unjustifiably burdensome, especially when there are other financial necessities that need to be addressed. For instance, my daughter will soon be getting her permit, and being able to allocate the funds currently designated for child support towards purchasing her first car would greatly benefit her.

In addition to these expenses, there will also be the added cost of providing for her school needs, including school clothes, sports uniforms, and other academic necessities. Given these circumstances, I am contemplating the possibility of temporarily putting the child support on hold through the Child Support Enforcement Agency (CSEA).

Furthermore, I am hesitant to reach out to my ex-wife regarding this matter, as I do not anticipate her cooperation. Therefore, I am considering seeking legal advice to understand my options and rights in this situation. By consulting with a lawyer, I aim to gain clarity on the legal process and the best course of action to address my concerns.

A change in living situation absolutely can change child support. Any change in custody should go through the court, and a change in support should be a part of that.

  • mduell

Potentially, but **not until you have the court order saying so**. The mere change in circumstances doesn’t alleviate you of any of your obligations in the current court order.

You need a lawyer, especially with a non-cooperative counterparty.

  • DancingUntilMidnight

It’s not “pausing” support. You’d need a modification to reflect the change in parenting time which would affect the child support order.

  • Cautious-Banana-9084

For the love of god, get a signed agreement or court order changing the parenting schedule and ask for a change in child support while doing this.

  • Jampot5

Wife wonÔÇÖt qualify for child support if child is with you. ItÔÇÖs to support the child not alimony for ex spouse. Go through the courts.

  • Jade_Austen

Sounds like youve got some good advice, but I would also like to add

Wait until she has started the school in your area!!!

If you make a move too soon, the Mum may stop your daughter from moving and then deny all knowledge that this was ever the plan in court. At least if she starts it shows the courts that this is the plan, both parents agreed at the start, and now Child support needs to be changed to reflect the change of main home.

  • Minimum_Donut5124

I just went through this in Ohio, you need to go through the court to get what the court calls a change in parenting time. At that point it can be referred to the csea for them to reevaluate the case and they will also put the money into an account till they finalize everything

  • zelda9333

If you think she will not agree to the move if you stop child support, then wait six months. Once she is there 6 months, then file for the change of child support.
