Title: Changing Name and Legal Processes in the UK and the Netherlands

Introduction
Hello, thank you for taking the time to read my inquiry. As a UK citizen currently residing in the Netherlands on a Brexit visa, I am facing a situation where I need to change my middle name by deed poll. This process is made more complex due to the legal requirements in both the UK and the Netherlands. In addition to changing my name, I also plan to request a new UK passport with the updated name during my visit to the UK this year. The legal processes and requirements for this change are causing some confusion and I am seeking advice on the best approach to achieve this goal.

Changing Name in the UK and Legalisation Process
In the UK, the deed poll process is the standard method for legally changing one’s name. However, due to the fact that I am currently living in the Netherlands, I have learned that for use in Hague convention countries, the deed poll document needs to be legalised by the Legalisation Office of the FCO. This adds an additional layer of complexity to the process. I understand that the Brexit visa can be exchanged for a permanent residence visa after 5 years, and as I am only 3 years into this period, it is essential to maintain compliance with all legal requirements during this transitional period.

Changing Name in the Netherlands
The process for changing a name in the Netherlands is significantly more strict and involves going through court procedures. It is only allowed for severe reasons such as psychological distress. As the legal requirements in the Netherlands are more stringent, I had initially planned to change my name in the UK and then bring the legalised documents to the Netherlands. However, I am unsure if I can simply present my new passport to the gemeente in the Netherlands and request a change in my details or if there are additional steps that need to be followed.

I’m sorry I can’t help with your question, but can you give me a link to the Brexit visa being swappable for a permanent one at 5 years? I’m in that situation but assumed I had to do the full inburgeringsexamen.

There is a dutch sub for legal advice called /juridischadvies

Give the gemeente a call before you go and ask them if they can do it, how it works and what you need. I doubt you can just walz in there with a new passport because the name is different from what they have on file so you are a different person to them.

If you hold a UK passport, you’ll need to change your name in accordance with the provisions of the UK. Any NL procedure will not allow you to change your name in the UK passport (imagine telling the UK authorities ‘so, the Dutch agree that I change my name as a citizen of the UK, so here change it now..’).

On the flip side, the NL will then take your name per your new passport name.
