**AI Legalese Decoder: Assisting with Vehicle Title and Lien Issues**

Facing Confusion: Seeking Assistance for a Vehicle Title Predicament
Greetings, everyone. Presently, I find myself in a rather perplexing situation, unsure of the appropriate course of action, and feeling quite bewildered about the potential consequences. A few weeks ago, I made a full payment to a dealership to purchase a vehicle. Recently, I received the vehicle’s registration in the mail, but to my surprise, the car was nowhere to be found when I prepared to use it for Uber/Lyft services. Concerned, I promptly contacted the police, who informed me that the car had been towed. However, since it was late in the evening by the time I realized the car was missing, I was unable to reach out to the towing company, as they had already closed for the day. In my desperation, I decided to call the dealer from whom I had purchased the car. Much to my dismay, I discovered that there was a lien on the vehicle dating back to April, although the dealer believed this to be a clerical error since there shouldn’t have been a lien in the first place. As a gesture of goodwill, the dealer has offered to rectify the situation with the bank. Regrettably, I am now at a loss, as I have no access to my vehicle and am uncertain about its return. Additionally, questions linger regarding my liability for the towing expenses and the recovery of my personal belongings. Grappling with these concerns, I humbly request any advice or guidance from those with experience in similar situations. What steps should I take moving forward?

You’ve got good advice about inspecting for and documenting tow damage, as well as notifying the dealership that you’re losing income because of their mistake.
BUT you should put everything with the dealership in writing. If you speak to them by phone, follow up with an email. Ex:
“Hey Jim, thanks for confirming that my car was towed due to an error on (DEALERSHIP)’s end. I’m looking forward to getting my car back asap because I’m losing X income each day without it. When I get it back, I’ll have my mechanic look it over and let you know if there was any damage done by the tow.”
Keep it friendly for now, to encourage them to continue being cooperative.
Then, if anything goes sideways, or you have the funds and want a quick consult, lawyer. I’d be looking into whether your state has any consumer protection laws on the books. Some come with *spicy* penalties for violations and can be used as good leverage in negotiating a settlement.
Edit to add- IAAL, I’m not your lawyer, and I’m probably not licensed in your jurisdiction.
Contact your insurance agency first and foremost. They have resources you donÔÇÖt
And make sure there is no “tow” damage to your car…
Take pictures of your car when you get it. Take someone with you when you do this. It sounds like the dealership is on the hook. Keep copies of EVERYTHING!! I presume you have pictures of your car BEFORE being towed. Also you might consider asking any fares you had within the 2-3 days prior to the tow that can attest to the condition of the car. (That could be important.)
Don’t sit on this. Get your car back ASAP. If the dealership will pay right then, great, if not get your car back cause you have bills…. Keep ALL of your receipts!!!!! Take pictures and tell your insurance company. If the dealership starts giving you shit, get a lawyer. Wherever you are there is a law group that can, at the very least point you,( for free) to a lawyer who can help if this gets really shitty.
When you get the car back from tow yard have someone do an INSPECTION right there and then. If they messed with anything and you canÔÇÖt prove it right then and there they will fuck you over so fast and youÔÇÖll be left with your keys in one hand and the bill for repairs in the other.
You need to call the dealer back and explain that you expect them to make you fully whole or you will be filing against them in small claims court within two days. They need to give you a full explanation of what they are doing to get the car back to you. I might also ask for lost earnings.
I would also immediately and without delay, look up whoever governs car dealers in your state and file a complaint.
In most states you can recover personal property from your vehicle. It should not be an issue. I would take bill of sale “PAID IN FULL” if you have it, to the tow yard. Check on the car take pictures while you get your property. If you have a cover put it on the car you never know.
NAL – Called the dealer? They said they’d make it right? Sounds like you’re on the right track.
A lien means another entity has a monetary interest in the vehicle that needs to be satisfied first. If it is indeed not an error, then the dealer needs to pay it and clear the title, or they need to get you into a different vehicle.
About personal belongings – I’d contact the towing company first. Maybe someone will let you pick up your stuff.
Lien holder – not sure if you can get this information, but I’d try asking the DMV first. If you do get their info, you can call them as well (though I don’t know what info they could/would give you).
Personally, it if it were me, I’d be at the car dealer asking them what they planned to do about this. Like I said, they either need to get your car back for you, or get you in something else (preferably a little better than what you had.)
Also try to find out who holds this supposed lien.
Make Police report and get copy, mail to insurance company and ask them what to do next .
If there is a lien go to owner of dealership with intent to get media involved should issue not be resolved .
Also itemize items and cost of personal items for insurance company as you are reporting a loss
So a dealer is selling a car with a lien? I would contact the lien people also to make sure that the dealer isnÔÇÖt lying and this wonÔÇÖt be happening again! Ask for the lien company to send you any and all info they have . Be nice but warn them itÔÇÖs your car and it is now stolen so they need to cooperate
Any costs you incur, request dealer make it right or else you file the losses back in small claims
Get on that dealerships azz. No reason you should have to do all that leg work looking for the lien holder etc. Dealership innocent or not is not your problem. They can’t be selling cars with liens on them. I bet they wouldn’t of financed it to you.
Call the police and report the dealership for fraud. 1984 is over. They have access and technology to verify and prevent deals like this. He needs to pay the lien holder and get you a clean title or refund your money.
Make sure they provide you with lost Uber wages and a rental until they fix this. Just because it was a mistake doesn’t cover the fact it is completely illegal. Also make a report with the police
Sometimes dealers will use the car as collateral to get loans on so that they can buy other cars and pay off loan when the car is sold. ThatÔÇÖs why they didnÔÇÖt have a title when you bought the car from them
[removed]
If you end up talking to a lawyer, the important concept here is ÔÇÿwarranty of titleÔÇÖ. Dealer is complaining about mix ups, errors as if itÔÇÖs someone elseÔÇÖs fault. No this is all on the dealer, even if they were defrauded.
