****** just grabbed a
Depends. Technically no, practically yes. Enforcement of child support can include seizing tax returns, funds from bank accounts, suspending driverÔÇÖs licenses, passportÔÇÖs professional licenses, or even incarceration. When youÔÇÖre married if any of those things happen you will likely be making up the difference for your spouse.
Think of it this his way as a basic simplified example. If your spouse usually puts their $1,000 tax return to pay for your mortgage but itÔÇÖs siezed by the state you still owe that money on your mortgage and if they donÔÇÖt have it elsewhere youÔÇÖre going to have to pay that difference or youÔÇÖre going to get late fees or eventually face foreclosure.
If you are marrying someone who pays child support you should 100% be budgeting with your spouse in a way that sets aside child support immediately.
In a way yes… My ex’s gf has been paying my child support for five years. He now owes 22k
My ex owed in excess and was found guilty of criminal nonpayment and contempt of court.
He will be on strict child support probation and observation for the next five years.. or more if he gets what they call sanctions. (If he misses payments.. quits his job)
It can be rough to be with a partner who owes arrears.
It will affect you and your children as well.
His girlfriend has had to bail him out of jail 4 times now from nonpayment and contempt.
criminal Non support is a felony. He received one per child… Fines and jail time.
Do NOT open up a bank acct with him.
My exes taxes are seized every year…. His money is garnished making him unable to pay rent or utilities.
They took his driver’s license and passport as well.
Just my opinion… I would NOT marry a man with serious arrears.. you have to deal with the loss
Tread cautiously, is he current or nearly so on his child support? How many more years is he expected to make support payments. Having to make support payments, doesn’t make a person bad, but a discussion about finances should be done before any marriage.
hello! in PA and iÔÇÖm NCP paying child support to CP who lives in California w our son. (we both lived in PA but never married when we had our son. CS was established in Pa.) long story short, i finally married and my wife and i have son together in Pa. and weÔÇÖve kept our finances separate because i do not want her to be affected by any CS enforcement if anything were to ever happen to me. if the NCP has a bank account, real estate, LLCÔÇÖs with anyone else, married not married whatever, it could effect the other party that shares ownership of any of those accounts or assets. LetÔÇÖs say i own a property w a sibling and we sell it and i happen to owe arrears, then those arrears will be garnished from the proceeds of the sale of that real estate. as far seizing bank accounts, they can totally be frozen if shared w someone in the event a deposit of $9,999.00 or more is deposited into that account. iÔÇÖve heard it as low as $5k deposits become frozen, whatever the case is, it really depends on the person you are marrying. iÔÇÖm a stand up man and pay what i owe every month and i happen to also be self employed so i pay on my own. iÔÇÖve never missed a payment or had it go to collection. iÔÇÖll be damned if i would let spite or anything else effect my credit score or my ÔÇ£freedomÔÇØ. i would hate to go to jail for something like that. so yes, it depends on the person your marrying that owes support.
** to note, if your partner owes any arrears in CS, ask him to pay it all before youÔÇÖs get married. that would really help if you plan on opening bank accounts together, joint tax filings or real estate.
No he just goes to jail
Not if you keep separate accounts
You should consider a prenuptial agreement (everyone should honestly) in that way youll each have full financial disclosure. You should request a record of his child support payments and court-order to verify that he is current on his payments both for your own financial well-being but also, I think it speaks to someones character if they have an excessive amount of arrears that they arent paying.
